Short-Term Rental Agreement

Sahkanaga View at Table Rock · Cleveland, Pickens County, South Carolina · [email protected] · sahkanagaview.com

1. Agreement and acceptance

This Short-Term Rental Agreement ("Agreement") is between Elisa Ann Whitmire, owner and host of Sahkanaga View at Table Rock ("Owner," "we," "us"), and the person who makes the reservation ("Primary Renter," "you"). The cabin, its furnishings, decks, yard, fire pit area and parking area are the "Property."

By checking the agreement box when you book, by paying for a reservation, or by staying at the Property, you agree to this Agreement for yourself and everyone in your party, including visitors you invite. You are responsible for making sure everyone in your party follows it. Your booking confirmation (dates, number of guests, price) is part of this Agreement.

2. The Property and your reservation

  • The cabin has 2 bedrooms with king beds and a finished basement with two twin-over-queen bunk-bed sets.
  • The street address, door code and directions are sent a couple of days before arrival.
  • Your reservation is for personal vacation use, only for the dates in your confirmation. It may not be transferred, resold or sublet.
  • The minimum stay is 2 nights (it may be longer in some seasons).

3. Check-in and check-out

  • Check-in is after 3:00 PM. Check-out is by 11:00 AM.
  • Early check-in or late check-out is only possible if we approve it in advance. An unapproved late check-out may be charged up to one additional night's rate.
  • Before you leave, please clean up dishes, place all trash in the large bin in the mechanical room in the basement, turn off lights and the grill, and lock the doors.

4. Occupancy and visitors

  • No more than 8 guests may stay overnight, including children.
  • Children ages 3–17 are welcome. The cabin does not provide cribs or other baby furniture.
  • Day visitors: up to 4 at a time, between 9:00 AM and 10:00 PM, with our approval in advance. Visitors may not stay overnight, and no more than 12 people may be at the Property at once.
  • Children under 6 should not sleep on the top bunks.

5. Primary Renter

The Primary Renter must be at least 25 years old, must stay at the Property for the whole reservation, and is responsible for the whole party. We may ask for a photo ID that matches the name on the reservation.

6. Price and payment

  • The price includes the nightly rate, a $155 cleaning fee, and 11% lodging tax (on the nightly rate and cleaning fee).
  • 50% of the total is charged when you book. The balance is charged automatically to the card on file 30 days before check-in. If you book within 30 days of check-in, the full amount is charged at booking. By booking, you authorize these charges.
  • If the balance charge fails, we will contact you. If it is still unpaid 3 days after our notice, we may cancel the reservation, and the cancellation policy in Section 7 applies.

7. Cancellation

  • Cancel 14 or more days before check-in: full refund.
  • Cancel less than 14 days before check-in: no refund.
  • Bookings made less than 14 days before check-in are non-refundable.
  • To cancel, email us. Refunds go back to the original card. We recommend travel insurance.
  • If we have to cancel your stay (for example, if the Property can't be used), we will refund everything you paid. That refund is the limit of our responsibility for the cancellation.

8. House rules

  • No smoking or vaping of any kind (including marijuana) inside the cabin or on the decks. Outdoors, only away from the cabin, with butts put in a closed container.
  • No pets. Service animals are welcome as required by law; please tell us in advance.
  • No parties or events (weddings, reunions, gatherings beyond your registered party and approved visitors) without our written approval.
  • Quiet hours are 10:00 PM to 8:00 AM. Please respect the neighbors at all times.
  • Fire pit and grill: use only the provided fire pit, keep fires small and attended by an adult, never leave a fire burning, and put it out completely with water before leaving it. No fires during burn bans or high winds. Use the grill only outdoors, away from railings and walls, and turn it off after use. No fireworks. No candles or open flames inside the cabin.
  • Vehicles and parking: all vehicles must be parked in the parking space provided on the Property, with no more than 4 vehicles. The gravel road leading to the driveway is a shared road and must never be blocked. Vehicles blocking it may be towed at the vehicle owner's expense. Do not block driveways or neighbors. No RVs, campers or trailers without our approval.
  • Trash: bag or gather all trash and place it in the large bin in the mechanical room in the basement. Never leave trash or food on the decks or anywhere outside, so animals can't get to it.
  • No illegal activity at the Property.

9. Damage and responsibility

  • There is no security deposit.
  • You are responsible for any damage to the Property beyond normal wear and tear caused by you, your party or your visitors. Please tell us about any damage or breakage as soon as possible.
  • We may charge the card on file for documented damage, cleaning needed beyond normal cleaning, or costs caused by breaking this Agreement (for example, smoking, pets, or extra guests). Before charging, we will notify you with documentation, such as photos and receipts or estimates, and give you a chance to respond. Any charge will be limited to reasonable actual costs. We will notify you within 14 days after check-out.

10. Use of the Property and release of liability

  • You use the Property and everything on it, including the decks, stairs, bunk beds, fire pit, grill, ping-pong and games, at your own risk. Please supervise children at all times.
  • The Property is close to state parks, trails, waterfalls and lakes. Hiking, swimming, boating, fishing and other outdoor or mountain activities carry real risks. We do not organize or supervise them, and you take part at your own risk.
  • To the fullest extent allowed by South Carolina law, you release the Owner from claims for injury, illness, loss or damage to people or belongings arising from your stay or these activities, except where caused by the Owner's gross negligence or willful misconduct. You agree to cover claims or costs caused by you, your party or your visitors.
  • We are not responsible for lost, stolen or damaged personal belongings or vehicles.

11. Rural mountain setting and wildlife

The cabin is in a rural, wooded mountain area. Black bears, deer, snakes, insects and other wildlife live here, and there are farm animals nearby. Do not feed wildlife, and keep food and trash secured. Roads in the area can be narrow, steep, winding or unpaved, and can be icy in winter. Cell service may be limited. Please drive carefully and plan for weather. The gravel road leading to the driveway is shared with neighbors: never block it, and park all vehicles in the parking space provided on the Property (see Section 8).

12. Owner entry and cameras

We respect your privacy. We or people working for us may enter the Property during your stay only for an emergency, urgent repairs, or to deal with a serious rule violation, and we will try to give you notice first when possible. For security, there is a video doorbell camera at the main entrance and 2 outdoor security cameras on the Property. There are no cameras inside the cabin, and no camera monitors any indoor space.

13. Breaking the rules

If you or your party seriously or repeatedly break this Agreement (for example, too many guests, parties, illegal activity, unsafe conduct, unauthorized pets, smoking indoors, or significant damage), we may end the reservation and ask everyone to leave right away, without a refund, and we may contact local law enforcement if needed.

14. Items left behind

We will try to contact you about items found after you leave. We can ship them at your cost. Food and perishables are thrown away. Items not claimed within 14 days may be donated or thrown away.

15. Wi-Fi, utilities and appliances

Wi-Fi, TV, power, water, hot water, heating and air conditioning, and appliances are provided as is. Outages and breakdowns can happen, especially in storms in a rural area. Please tell us right away and we will work to fix things quickly. These interruptions are not grounds for a refund unless the cabin becomes unlivable for an extended time.

16. Weather and events outside our control

We are not responsible for events outside our reasonable control, such as severe weather, natural disasters, wildfire or burn bans, road closures, power outages, government orders, or public health emergencies. Except as stated in this section, the cancellation policy in Section 7 still applies, so we recommend travel insurance. If we can't provide the Property for some or all of your nights because of such an event, you may choose either (a) a refund of 50% of the lodging cost for the nights you could not use, or (b) a free reschedule of those nights to other available dates within 12 months of your original check-in date, subject to availability.

17. General terms

  • This Agreement is governed by the laws of the State of South Carolina. Any dispute will be handled in the courts of Pickens County, South Carolina.
  • This Agreement, your booking confirmation and the house rules posted at the Property are the whole agreement between us. If any part of it can't be enforced, the rest still applies.
  • Notices may be sent by email: ours is [email protected], and yours is the email you booked with.
